You'd have to port the old driver to the new kernel, not necessarily an easy task depending on what's changed.

We package the rootfs with 3.1 because not everybody has a compatible u-boot. Most things work fine with 3.1...hell, I haven't upgraded any of my plugs to linux-kirkwood because I have no real need.

As for getting your system to boot to a rootfs on a 3rd partition, you would have to modify your u-boot params as that is a very non standard way of doing things.

Some examples here. You could use fw_setenv usb_scan_1 'usb=0:3 dev=sda3' and so on, if the other USB HD also contains the system (not just /boot).
